CBD is everywhere now, thanks to the 2018 Farm Bill legalizing hemp and its derivatives for the first time in over 40 years. Yet even with federal approval, some states are still working to catch up on their own legislation and a couple, in particular, have been dragging their feet.
The Indy Star published an article last December titled “CBD flower is legal in Indiana. But it still could get you arrested. Here's why.” These types of articles have scared countless Indiana residents away from trying CBD, even though it is completely legal under federal law as long as it contains less than 0.3% THC.
The article discussed how, despite the legality of CBD, Indiana citizens can and have been pulled over and arrested for possessing CBD flower because at the time of arrest, police could not distinguish the difference between hemp and marijuana (cannabis with more than 0.3% THC).
Regardless, this does not mean Indiana citizens can’t buy CBD flower or any other type of CBD. Because of the confusion and mistaken identities, though, products must meet certain labeling requirements and have QR codes that link to the ingredients. This includes all types of CBD flower, oil, vape, and other products. These QR codes should also link to test results that clearly show the concentration of THC in the product.
